More on Developmental Disabilities and the Death Penalty
An Arkansas man, Rickey Dale Newman was scheduled for execution last night. His death was thwarted by the state Supreme Court, as there was evidence that he may have a developmental disability.
It appears the US Supreme Court ruled in Atkins v. Virginia (June 2002) that people with mental retardation couldn’t be executed.
The Death Penalty Information Center has some very useful information on this subject.
Including a break down of how the different states define mental retardation/developmental disability.
The site also has a link to The Angolite a magazine produced by inmates at Louisiana’s Angola State Prison. The article in the Angolite looks at the commutation of Herbert Welcome, a man with mental retardation whose death sentence was lifted by Governor Mike Foster in 2003.
